D | 到山脚后，两人停车，背起工具徒步进入天目山—清凉峰生物圈保护区。山里的植被茂密，灌木丛中偶尔冒出几株形态特别的植物。赵某先发现了第一株。这株植物轮生的七片叶子托着一朵花，像一把撑开的伞，在山风中轻轻摇曳。“七叶一枝花。”刘某认出来了。二人对视一眼，心里都清楚，这东西不一般。七叶一枝花，学名重楼，国家重点保护野生植物，在民间被称为“蛇药王”，也是云南白药的重要成分。无论是采挖、运输，还是出售、收购，每一样都踩在法律红线上。“我们经常上山，这个药很有效果。反正山这么大，没人看见。”赵某抱着侥幸心理，弯下腰，徒手扒开泥土，将它连根拔起，一株、两株、三株……两人越挖越顺手，从山脚到半坡，一路挖了18株七叶一枝花。两人下山后，被当地村民发现，并报警。经鉴定，这18株七叶一枝花未造成实际损毁，最后被种回了保护区。

E | 临安区法院审理认为，两名被告人违反国家规定，非法采挖国家重点保护植物，情节严重，行为已构成危害国家重点保护植物罪，最终判处二人有期徒刑并处罚金。不少人以为山上的野生植物可以随意采挖，这是非常错误的想法。案件承办法官提醒大家：根据《中华人民共和国自然保护区条例》相关规定，禁止在自然保护区内进行砍伐、放牧、狩猎、捕捞、采药、开垦、烧荒、开矿、采石、挖沙等活动。七叶一枝花、野生天麻、野生兰花、贝母、石斛等常见山野植物，均已被列入国家重点保护名录，尤其在保护区内，寸草勿动。同时，国家对野生动植物领域的违法犯罪实行全链条打击，采挖、收购、运输、加工、出售任一环节均追责，网络兜售同样严查。
